What is the law for the trial of civilians in military courts?  Seeking response from the Ministry of Law

Peshawar: On the plea against the trial of civilians in military courts, the Additional Attorney General said that there is already a law in this regard which Peshawar High Court has sought a response from the Federal Ministry of Law.

A hearing was held before Justice Abdul Shakur and Justice Syed Arshad Ali in the Peshawar High Court on the petition filed against the amendments in the Army Act and the Official Secrets Act. The petitioner’s lawyer Qazi Anwar Advocate said that a civilian cannot be tried in an army court because the amendments that have been made have not been signed by the President, without the President’s signature this cannot become a law.

Justice Syed Arshad Ali inquired that if the President did not sign, then he had to return it? Justice Abdul Shakur said that the trials in the military court have been started under the same law.

Justice Syed Arshad Ali further asked the petitioner’s lawyer that what amendments have been made in the Army Act and the Official Secrets Act? On this, the petitioner’s lawyer, Qazi Muhammad Anwar, said that the court should give some time and will give arguments on it in detail.

During the hearing, Additional Attorney General Sanaullah said that the Army Act and the Official Secrets Act already have a trial related to civilians. The court adjourned the hearing after seeking a response from the Federal Ministry of Law on this statement.
