Islamabad: The Supreme Court of Pakistan has restrained all High Courts from quashing ‘ongoing investigations and FIRs’.

The Supreme Court has said that the High Court has no power to quash the investigation or FIR as the High Courts cannot exercise the power under Section 561A of the Penal Code.

However, the Supreme Court has said that the option of Section 561 can be used only if the accused have applied for acquittal in the trial court. High Courts can set aside orders of subordinate judiciary but not investigations.

It is also said that the High Court can investigate and review cases under constitutional jurisdiction. The Supreme Court has said in a case hearing that the powers given to the government officers are actually upper-in-trust and has also asked the government officers to use their powers with transparency and good faith.

Accordingly, the Supreme Court has said that no offense has been committed in the up-gradation of employees in CDA. The Supreme Court has also fined the FIA ​​inspector for filing an unnecessary appeal. In this regard, Irfan Barki, head of FIA Corporate Crime, Islamabad, has been fined Rs.

The court has ordered that Irfan Barki should pay the fine from his personal expenses in one month to the registrar’s office, which will be given to the CDA officers named in the case.

According to the Supreme Court, if the fine is not deposited, the court will issue an appropriate order. Finally, FIA’s appeal against the decision to quash the case against the CDA officers has also been dismissed.
