Lahore: The High Court ordered Chief Commissioner Islamabad and IG Islamabad to safely produce Parvez Elahi before the court and adjourned the hearing till tomorrow.
When the hearing of the case resumed, lawyer Pervaiz Elahi said that the order of the Islamabad High Court has also been suspended. The court remarked that his arrest was declared illegal, how can this matter go under the jurisdiction of Islamabad and the arrest was declared illegal by the Lahore High Court.
Lawyer Pervez Elahi said that Pervez Elahi should be produced in Lahore High Court, this is what the court has ordered. The court said to produce Chief Commissioner Islamabad and IG Parvez Elahi in court.
The public prosecutor said that we have challenged the court order, our pleas should be heard before producing Parvez Elahi.
The court remarked that I am only saying that the order of the court must first be implemented.
Earlier, the High Court summoned IG Islamabad, Chief Commissioner Islamabad and Superintendent Attock Jail till 11 am on a plea against the arrest of Chaudhry Pervaiz Elahi despite the court order.
Lahore High Court Justice Mirza Waqas Rauf heard the request of Parvaiz Elahi’s wife Qaisara Elahi. A contempt of court and habeas petition was filed against DIG Investigation, DIG Operations and SSP Operations.
The court adjourned the hearing till 11 o’clock on the plea of habeas corpus.
During the hearing, the court expressed its displeasure at not producing Parvez Elahi. The court expressed its displeasure at the non-appearance of the IG Islamabad and issued show cause notices to the IG Islamabad.
The court remarked why you should not be punished for contempt of court. The court declared that there was a clear order of the court to produce Parvez Elahi. The court directed that the lawyers of the federal government appear and explain.
The government lawyer said that Parvaiz Elahi was not presented due to heart problem, DC Islamabad prohibited him from traveling due to illness. Government lawyer Ghulam Sarwar Nahang said that Pervez Elahi has been detained by DC Islamabad under the threat of public order.
Additional Advocate General Punjab Ghulam Sarwar Nahang opposed the petition for habeas corpus and pleaded that the petition for habeas corpus is no longer justified.
Deputy Superintendent of District Jail Attock and District and Sessions Judge Attock appeared as bailiffs. The report said that Parvez Elahi could not be recovered due to detention.
Qaisara Elahi’s lawyer took a stand that IG Islamabad did not appear in the contempt of court and should be summoned. The court expressed its displeasure at the non-appearance of the superintendent of the jail.
The public prosecutor’s position was that the jail superintendent did not appear because of Imran Khan’s court appearance. The court has summoned the IG Islamabad by issuing a notice of contempt of court.
