NAB amendments in July are doubtful, Supreme Court

Islamabad: The Chief Justice of Pakistan has remarked during the hearing of the case that the NAB amendments made in July are suspicious.

In the Supreme Court, a hearing was held on NAB’s appeal against the order to inform League leader Javed Latif before his arrest, in which the NAB prosecutor argued that the decision to inform the accused before his arrest is against the law.

The Chief Justice remarked that Javed Latif’s case was at the level of inquiry, in which no arrest could be made. The NAB prosecutor said that after the amendment of July 3, 2023, arrest can also be made during the inquiry, on which Chief Justice Umar Atta Bandyal said that the NAB amendment made in July is doubtful. The NAB amendments made on July 3 are in conflict with the court decisions.

The Chief Justice inquired that how can the servant called for questioning be put in jail? The NAB Act was draconian till 2001. Amendments in the NAB law to reduce the period of remand and to grant bail are good.

Justice Athar Manullah said that NAB law can be interpreted only in the context of court decisions and the constitution.

Later, the court dismissed NAB’s appeal against the order to inform the accused before arrest. The court declared that the order of the High Court is prior to the July 3 amendment, on which NAB Prosecutor Rizwan Sati took the stand that the NAB amendment has been applied from the past. The Chief Justice replied yes, leave these things.
