Lahore: The Supreme Court suspended the order to accept the resignation of 43 members of National Assembly of Tehreek-e-Insaf.

43 members of the assembly of PTI, including Riyaz Fatiana, approached the court against the acceptance of resignation. Justice Shahid Karim of Lahore High Court suspended the order to accept the resignation of 43 members of the National Assembly while hearing the petition.

The petitioners challenged the Speaker’s January 22 and the Election Commission’s January 25 notifications, contending that the MLAs had withdrawn their resignations before they were accepted. After withdrawing the resignations, the Speaker has no power to accept the resignations. Accepting the resignations of members of the assembly is against the law and based on malice.

The PTI MLAs further said in the petition that the resignations will be accepted contrary to the rules laid down by the Supreme Court. The Speaker of the National Assembly accepted the resignations to target political revenge. Didn’t ask. In the petition, it was requested that the court declare null and void the move of accepting the resignation of the Speaker of the National Assembly and also nullify the notification of the Speaker and the Election Commission.

On the occasion of hearing in Lahore High Court, barrister Ali Zafar appeared on behalf of former 43 members of National Assembly including Riaz Fatiana. Earlier, the Speaker’s notification of January 22 and the Election Commission’s notification of January 25 about accepting the resignations of the members of the Assembly were challenged.

According to the counsel for the petitioners, 43 members had written to the Speaker on January 23 to withdraw their resignations. The Speaker did not conduct an inquiry under the Constitution before accepting the resignation. The petitioners never appeared before the Speaker. The Speaker cannot accept resignations without hearing the members. Therefore, the court should annul the notification of the Speaker and the Election Commission.
