Detailed decision on the appeal against the May 9 arrest of Chairman PTI


The Supreme Court of Pakistan (SCP) has issued a detailed decision on the appeal against the May 9 arrest of Chairman Pakistan Tehreek-e-Insaf (PTI) Imran Khan.

The 22-page detailed judgment has been written by Chief Justice Umar Atta Bandial.

In its decision, the Supreme Court declared the arrest warrant of Chairman PTI illegal.

It was stated in the judgment that Chairman PTI approached the High Court for pre-arrest bail in the Al-Qadir Trust case. At the time of Biometric, Rangers forcibly entered the diary branch and arrested Chairman PTI.

The detailed verdict further said that the Rangers broke the glass in the High Court premises, tortured the lawyers and staff, the Chief Justice of the Islamabad High Court took notice of the arrest incident on May 9.

The judgment also said that the Chief Justice of the High Court declared the method of arrest as wrong and the arrest as legal, Chairman PTI approached the Supreme Court to declare the arrest as illegal.

The detailed verdict stated that Chairman PTI was produced in the court at 4:30 pm on the order of the court, the court allowed Chairman PTI to come to the rostrum to give a statement on the May 9 incidents.

In the judgment written by the Chief Justice of the Supreme Court, it was said that the chairman PTI expressed ignorance of the events after his arrest, the court asked whether he condemned the events of May 9. Chairman PTI assured and said that he never incited followers to violence.

In the detailed judgment, it was said that the petitioner expressed his disappointment at the arrest from the premises of the Islamabad High Court, the brief order was issued immediately after hearing the NAB Prosecutor and the Attorney General.

The judgment said that the apex court in its summary order declared the arrest warrant of PTI chairman illegal and allowed the PTI chairman to meet the named people at the police guest house.

In the detailed judgment, it was said that the fundamental right to justice was violated by arresting the accused from the court. And there will be transparent justice.

The verdict said that the Chairman PTI had surrendered before the court after appearing in the High Court, the manner in which the arrest was made violated the authority and sanctity of the High Court.

In the detailed decision, it was stated that earlier the Supreme Court has taken contempt of court proceedings on the arrest of the covered court.

The judgment said that the High Court gave priority to its sanctity over the fundamental right of the citizen to seek justice, the court can grant security to meet the requirements of the Supreme Court.

It was further said in the judgment that if the arrest was declared legal, the bail application filed in Al-Qadir Trust would have become ineffective, if the arrest was declared legal, the arrest from the court would have become normal in the future.

In the detailed judgment of the Supreme Court, it was said that if the court had confirmed the arrest, the police, law enforcement agencies would have made the court premises a hunting ground for the accused.

The judgment also said that the law enforcement agencies including the police would have been allowed to misbehave with the accused in the court premises.
