The Supreme Court of India on Monday finally constituted a 5-member larger bench to hear the petitions filed against the abrogation of Article 370 of the Constitution.
It should be remembered that Article 370 gives special status to Occupied Jammu and Kashmir, which was the key to its accession to India in 1947.
Now, a 5-member larger bench of the Supreme Court, headed by Chief Justice Dhananjaya Yashwant Chandrachud and comprising Justice Sanjay Kishan Kaul, Justice Sanjeev Khanna, Justice BR Gavai and Justice Surya Kant, will hear the case on July 11.
According to Indian media reports, more than 20 petitions have been filed against the abrogation of Article 370, filed by Shah Faisal and others.
This decision of the Indian Supreme Court has been welcomed by the political leaders of Occupied Jammu and Kashmir Umar Abdullah and Mehbooba Mufti.
It should be noted that on August 5, 2019, the Modi government abolished the special status of the occupied valley and stripped it of the status of a state and declared the occupied Jammu and Kashmir a territory of the Indian Union and in view of the danger of tension spreading there, the valley was not occupied. A small number of Indian troops were also deployed.
The move was taken when Indian Home Minister Amit Shah moved a resolution in the Rajya Sabha to abrogate Article 370.
The then Prime Minister of Pakistan termed the Indian move to abrogate Article 370 as illegal and destructive to regional peace and security.
This initiative of the Indian government also gave the right to the people of the rest of the country to acquire property in the Occupied Jammu and Kashmir region and to settle there permanently, which was not acceptable to the people of the valley and it was an international violation. It is also a flagrant violation of laws, UN resolutions and the Indian Constitution.
