Islamabad: A three-judge bench of the Supreme Court issued a writ of suo motu notice and adjournment of hearing on cases of constitutional importance.
According to Express News, the 3-member bench of the court issued the said written order in the case of awarding additional marks to Hafiz Quran, the 9-page decision was written by Justice Qazi Faiz Isa, with which Justice Shahid Waheed disagreed.
The written judgment states that the Constitution and the law do not allow the Chief Justice to constitute a special bench, the rules are in place with respect to petitions filed under Article 184 III.
In the judgment written by Justice Qazi Faiz Isa, it is written that there are no rules for appointing somoto cases and forming benches, until the rules are formed, the hearing on important constitutional and automatic cases should be postponed.
It is also written in the written decision that PEMRA’s ban on criticizing judges is against the Constitution and Islam.
It is written in the judgment that during the hearing, the attention of the court was drawn to the ban on broadcasting criticism of judges by PEMRA, PEMRA imposed the ban by referring to the decision of the Supreme Court, the court decision to issue such an order to PEMRA. Does not allow, District Court Judges do more work than Supreme Court and High Court Judges.
In the written decision, it is written that PEMRA has never imposed a ban against criticizing the judges of the district judiciary, the non-accountability of the judges who make others accountable is against the constitution and Shariat, the public trust has to be won by the institutions themselves.
