Non-bailable warrant: Imran Khan's decision to challenge Sessions Court order

Islamabad/Lahore: Pakistan Tehreek-e-Insaf Chairman Imran Khan has decided to challenge the Islamabad Sessions Court’s order to uphold the non-bailable arrest warrant in the Tosha Khana case in the Islamabad High Court.

According to correspondent Express News, Imran Khan’s lawyer Khawaja Haris Advocate will file a petition in the Islamabad High Court, in which an urgent hearing will be requested on the request to possibly transfer the Tosha Khana Criminal Code case to another judge.

It should be noted that on Thursday, the sessions court rejected the request to cancel the non-bailable warrant after Imran Khan’s written assurance and ordered the PTI chairman to be arrested and produced in the court.

In the detailed decision released by the court, it has been written that Imran Khan’s warrant cancellation request is rejected, the petitioner created a law and order situation in Lahore, such behavior is not acceptable to the court in any way. After the situation, Imran Khan is not entitled to any general legal relief, Imran Khan will have to appear in person for violation of court proceedings.

The written judgment said that the law is equal for all sections of the society, strong and weak, it is not a joke that after causing such a huge loss to the national treasury, the undertaking is given, the national treasury, property and people in Lahore are heavily burdened. Harm has been done, the warrant cannot be canceled on mere undertaking after this conduct and action of Imran Khan, Imran Khan’s lawyer described the resistance to the execution of the warrant as regrettable.

In the judgment, it is written that Imran Khan challenged the writ and sanctity of the state, brutal force was used to obstruct the performance of police duties, after creating all these situations, Imran Khan is not entitled to suspend the arrest warrant. It was written in the court verdict that Imran Khan is the chairman of Tehreek-e-Insaf, his followers obstructed the execution of the arrest warrant of the police, due to the conduct and action of Imran Khan, millions of rupees were spent by the poor nation. Obliged to assist in execution, the court issues warrants for the accused’s continued non-appearance despite summons.

It was written in the judgment that the court orders the police to arrest and produce the accused in a non-bailable warrant, the arrest warrant is canceled when the accused appears before the court, it is noteworthy that the police arrested Imran Khan without delay. The police can execute Imran Khan’s non-bailable warrant anywhere in Pakistan, the police officer to whom the warrant is issued is bound to execute it, according to court records. According to Imran Khan, he never appeared in court in this case.

It has been said in the judgment that this court granted Imran Khan’s request for exemption from personal appearance four times.
