If the matter was in the High Courts, the Supreme Court could not have taken notice, dissenting note
Islamabad: The 5-member larger bench of the Supreme Court has ordered elections to be held in Punjab and Khyber Pakhtunkhwa within 90 days.
The five-member bench gave the decision in the ratio of three to two. Justice Jamal Mandukhel and Justice Mansoor Ali Shah gave a dissenting note.
Justice Mansoor Ali Shah in a dissenting note said that there is no reason to take automatic notice, the notice was taken in haste, Supreme Court should not have used the power of automatic notice.
In the dissenting note, it was said that if the matter was in the High Courts, the Supreme Court could not have taken notice, the Lahore High Court had already decided the case, the matter in the High Courts was delayed due to automatic notice, the High Courts should decide the pending cases quickly.
