Peshawar High Court reinstated local body representatives

Peshawar: The High Court suspended the announcement of the suspension of local body representatives by the Election Commission of Pakistan and reinstated the local body representatives.

The court issued a notice to the Election Commission of Pakistan, Attorney General and Advocate General and adjourned the hearing of the case to March 2 tomorrow.

The case was heard by a two-member bench of Peshawar High Court comprising Justice Rooh Ul Amin and Justice Ishtiaq Ibrahim. The writ petition has been filed by Allah Mayar and other local body representatives in support of Nowshera Tehsil Mayor Ishaq Khattak Mardan.

When the two-member bench started hearing the case, advocate Babar Khan Yousafzai appeared on behalf of the petitioner, supporting Allah Mayar, while Noman Kakakhel and Malik Shehbaz advocates appeared in the court on behalf of Ishaq Khattak and others.

He told the court that the Election Commission has suspended the local government representatives which is an unconstitutional measure. The role of the local government is very prominent in democracy. Local government representatives were suspended on the basis of influencing the provincial general election. If so, Abolish the federal government also because the federal government will also use government resources in the by-elections and provincial general elections.

He told the court that the political system in any country is not complete without a local government system, the budget of the local government has been prepared for which the planning is also complete. With the planning process for the next year also underway, it is unthinkable to suspend the local government system at this stage.

According to the counsel for the petitioner, local bodies have been implemented under Article 140 (A) of the Constitution and its suspension in this case is a suspension of a provision of the Constitution which in any case does not lie with the Election Commission as it is transparent. If it wants to do this under the pretext of elections, then it is necessary to suspend the entire governments.

According to the petitioner, the Election Commission is responsible for transparent elections and they will conduct the elections in a transparent manner. not correct. At the same time, policies are made under the local government that have a direct impact on the local people, including schools, education, health and other sectors.

He requested the court to declare the declaration issued by the Election Commission null and void.

After hearing the arguments, the court suspended the declaration of the Election Commission of Pakistan and issued notices to the Election Commission of Pakistan, Attorney General and Advocate General and adjourned the hearing of the case to March 2.

In this regard, the petitioner’s lawyer Babar Yousafzai told the media that after the suspension of the declaration of the Election Commission, all local government representatives of the province have been restored because when the declaration of the Election Commission is suspended, the local government representatives are restored automatically.
