Islamabad: On behalf of the government, the acquittal of Imran Khan and Shah Mehmood Qureshi in the cipher case was challenged in the Supreme Court.

According to Express News, the government has filed an appeal in the Supreme Court against the acquittal of founder chairman PTI Imran Khan and Shah Mehmood Qureshi in the cipher case.

Appeals have been filed in the Supreme Court against the High Court’s decision of acquittal of former Prime Minister Imran Khan and former Interior Minister Shah Mehmood Qureshi in the cipher case through the Ministry of Interior.

In the appeal filed in the Supreme Court, it has been held that the High Court has no jurisdiction to hear the appeal in the cipher case. It is a settled principle that when Parliament does not write something into law, it cannot be added to by a judicial decision. . PTI founder Imran Khan and Shah Mehmood Qureshi were non-cooperative during the cipher trial.

The petition filed by the Ministry of Home Affairs further stated that the records proved that both the accused had filed 65 separate petitions during the trial. The hearings were adjourned several times at the request of the accused. Witnesses appeared in the cipher case, but the lawyers of the accused did not cross-examine them. The lawyers of the accused were provided lawyers at the government expense.

It was argued in the petition that it is settled principle that if the legal requirements are not met in a trial, the matter is sent for re-trial. In the cipher case, the prosecution presented solid evidence. Prosecutors presented documentary and forensic evidence in the cipher case, which was not rebutted at trial. The Islam High Court did not take into consideration the concrete evidence presented in the cipher case. It has been requested from the court that the appeals against the verdict of acquittal in the June 3 cipher case of Islamabad High Court should be fixed for hearing.

It should be noted that the Islamabad High Court acquitted Imran Khan and Shah Mehmood Qureshi in the cipher case and accepted the appeals against the trial court’s decision. After hearing the appeals of founder PTI and Shah Mehmood Qureshi in the cipher case, the High Court declared the sentences void and acquitted them from the case.

After the decision of the High Court, the government spokesperson Barrister Raqeel Malik said in a press conference that the courts should realize that the cipher is a reality and there can be no compromise on national security.
