Peshawar: The court sought a response from the Chief Minister KPK and the Speaker of the Assembly on the petition filed against the non-taking of oath on certain seats in the Pakhtunkhwa Assembly.
The case was heard by Peshawar High Court Justice SM Atiq Shah and Justice Waqar Ahmed. During the hearing, the court inquired as to why the oath was not taken after the detailed decision, on which the petitioner’s lawyer told the court that the detailed decision has also come and 14 days have passed but the oath was not taken.
Later, the court issued a notice to the Chief Minister KPK and the Speaker of the Provincial Assembly and sought their reply within a week.
On the other hand, Speaker Khyber Pakhtunkhwa Assembly filed a petition in the Peshawar High Court for review of the March 28 decision on the issue of non-swearing of elected members on certain seats, which was heard by Justice SM Atiq Shah and Justice Shakeel Ahmed. The court approved the revision petitions for hearing and issued notices to the parties.
Meanwhile, PPP’s Shazia Tahamas has filed a contempt of court petition against the non-taking of oath by members on specific seats, which was heard by a 2-member bench comprising Justice Ijaz Anwar and Justice Waqar Ahmed. During the hearing, lawyer Amir Javed told the court that the Peshawar High Court had ordered the elected members to take oath on March 28. In a detailed judgment, the court ordered the chief minister, cabinet and speaker to take oath from the members within 14 days.
The lawyer argued that 14 days have passed and yet the members have not been sworn in. Later, the court issued instructions to inform the Advocate General’s Office about the matter.
