Peshawar: An application was filed in the High Court by PML-N against giving a special seat to Jamiat Ulema-e-Islam.
Pakistan Muslim League-N Khyber Pakhtunkhwa has filed a petition in the Peshawar High Court against the decision of the Election Commission on the issue of giving a minority seat to the JUI by the Election Commission, in which the Election Commission, Speaker of the Provincial Assembly and JUIF Gorpal Singh, a minority member, has been made a party.
In the petition filed in the High Court, it has been argued that the Election Commission had issued a declaration in the name of Gorpal Singh on the minority seat on March 26. It is further stated in the application that 7 specific seats of Muslim League-N were formed. The Election Commission gave 6 seats instead of 7. The Election Commission has reduced one seat to the petitioner party against the Constitution, Election Act and Rules.
The PML-N’s petition further states that the Constitution and the Election Act have fixed the formula for specific seats. Contrary to the formula, the Election Commission has deprived the petitioner party of a minority seat. The Election Commission’s decision is unconstitutional and illegal. The court should declare the Election Commission’s declaration null and void and restrain the Speaker Assembly from administering oath to Gorpal Singh till the final decision on this petition.
