Islamabad: The Accountability Court Islamabad has reserved its decision on the acquittal pleas of former prime minister Nawaz Sharif’s sons Hassan Nawaz and Hussain Nawaz in the Al-Azizia, Avonfield and Flagship references.
Accountability Court judge Nasir Javed Rana will pronounce the decision on acquittal at 2 pm.
During the hearing, NAB Prosecutor Afzal Qureshi informed the court that we have not filed an appeal in the Supreme Court against the acquittal of Maryam Nawaz, Hasan and Hussain Nawaz are accused of conspiracy and aiding and abetting. Deputy Prosecutor NAB said that it is their case that the main accused in these references have been acquitted.
Counsel for Hasan and Hussain Nawaz, Kazi Misbah, advocate said that the Islamabad High Court acquitted Nawaz Sharif, relying on the documents on which the court had acquitted Maryam Nawaz, Nawaz Sharif was acquitted. No appeal was filed in the Supreme Court against Nawaz’s acquittal and a copy of the High Court’s decision is available on the High Court’s website.
The petitioner’s lawyer said that the trial court sentenced Nawaz Sharif in the Al-Azizia case and the Islamabad High Court accepted Nawaz Sharif’s appeal in December 2023. Hasan Nawaz and Hussain Nawaz cannot be punished even on the evidences that are available, running a case against Hasan Nawaz and Hussain Nawaz will be a waste of court time.
Qazi Misbah Advocate said that if the main accused in the case is acquitted, the case cannot proceed on the charge of aiding and abetting. Nawaz Sharif was acquitted by the trial court in the flagship reference. And he was acquitted by the Islamabad High Court, NAB did not even appeal to the Supreme Court against the decision of acquittal, even if all the evidences are accepted, there is no chance of punishment.
The NAB prosecutor said that the NAB had withdrawn its appeal to increase the sentence in the Al-Azizia reference. After hearing the arguments, the court reserved its decision on the pleas of acquittal.
