Islamabad: In the Supreme Court Practice and Procedure case judgment, Justice Mansoor Ali Shah’s additional note was also made a part of the judgment.
According to the details, in the Supreme Court Practice and Procedure case, Justice Mansoor Ali Shah wrote a dissenting note in which he said that the doctrine of past and closed transaction will be applied to the benches formed by the former Chief Justice.
He wrote that a major part of the public time has been spent on these benches and hearings. After the suspension of the Practice and Procedure, the former Chief Justice formed the benches under the effective law. It can be said that the Act should not have been suspended, but The fact is that the Act was suspended.
Justice Mansoor Ali Shah wrote that the 8-member bench of the Supreme Court had suspended the Act.
Other judges including the Chief Justice of Pakistan have agreed with Justice Mansoor Ali Shah’s note. All the judges who gave the majority decision agreed with the note and said that the note of Justice Mansoor Ali Shah should be considered as a part of the original decision.
Justice Mansoor Ali Shah said in the note that the review applications against the decisions given after the implementation of the law will be heard as an intra-court appeal, the intra-court appeal will be made by a five-member larger bench.
