Islamabad: A 6-member larger bench of the Supreme Court broke down during the hearing of a case related to the trial of civilians in military courts.
Justice Sardar Tariq Masood recused himself from the bench. Justice Sardar Tariq Masood was heading a six-member bench on intra-court appeals against the decision declaring military courts unconstitutional.
When the hearing started, Justice Sardar Tariq Masood said that we will hear the objections on the bench first.
Jawad S Khawaja’s lawyer raised objection to the bench and said that the matter should be sent to the Judges Committee for the reconstitution of the bench.
Lawyer Hamid Khan of Lahore Bar tried to give arguments in the case, on which Justice Sardar Tariq Masood remarked that if we do not want to hear the case, then we should not give arguments. .
The court referred the matter to the Practice and Procedure Committee for the constitution of the bench. The court said that the Practice and Procedure Committee should constitute a larger bench, the order of military courts to continue the trial of civilians will remain.
