Rejecting the status of Election Commission, the Sindh government extended four years to the Executive Director IBA

Karachi: The Sindh government has extended the tenure of the executive director of IBA Karachi by four years, rejecting the constitutional opinion and status of the Election Commission of Pakistan.

The evidence received by “Express” from the Department of Universities and Boards and S&GDA shows that the support of the letter containing the office opinion of the Advocate General Sindh for the extension of the tenure of the Executive Director of IBA, Dr. Akbar Zaidi. has been taken.

He has given this opinion on the request of the Government of Sindh, however, in the entire letter containing the legal opinion of the Advocate General of Sindh, there is no mention of “tenure of four years”, but only the extension of the tenure has been suggested. Duration not determined.

According to the sources of the Sindh government, after the opinion of the Advocate General came out, the Caretaker Chief Minister of Sindh Justice R. Maqbool Baqir himself decided to extend the term of the Executive Director of IBA to four years.

It should be remembered that the Election Commission of Pakistan, in a letter addressed to the Sindh government on January 5, had given permission to extend the tenure of the Director IBA by only 3 months, after which the Sindh government, in the meantime, asked the Advocate General of Sindh. Asked for opinion on the matter.

The legal opinion of the Additional Advocate General Sindh Syed Muhammad Salat Rizvi on behalf of the said department was received by the Sindh government on January 10, in which he gave a legal opinion and took a stand that the tenure of the executive director of IBA on behalf of the competent authority. There was no need to put the issue of extension before the Election Commission.

He said that the issue of Executive Director IBA vacancy is not related to election affairs and administration and it is also worth mentioning here that the employees and officers of IBA are not civil servants.

Further, in this legal opinion, it has been said that the decision of the Election Commission of December 5, 2023, which has been suspended by the High Court, will now be dominated by the order of the High Court dated December 29, 2023.

It should be remembered that in the order of the Election Commission of December 5, the Sindh government was stopped from extending the tenure of Dr. Akbar Zaidi, after which Syed Nadeem Hussain, the husband of the former senator of the People’s Party, reached the Sindh High Court against this order and In the order issued by the High Court on December 29, this order of the Election Commission was suspended till January 30, 2024.

Meanwhile, in the letter received from the office of the Advocate General to the Government of Sindh, it is further stated that the Government of Sindh received a new order from the Election Commission on January 5, in which the tenure of the Executive Director of IBA was extended by 3 months. Permission granted.

In this letter, the Advocate General’s office issued its final opinion on the matter, saying that there is no obstacle in extending the tenure of Dr. There is no rest.

It is noteworthy that in this final opinion, the Office of the Advocate General as the Executive Director of IBA is not fixing any period for the extension, but the letter of the Election Commission which is being referred to here is also an extension of 3 months. It is related, but despite this, on the orders of the caretaker Chief Minister of Sindh, a notification has been issued to extend the tenure of the Executive Director of the Department of Universities and Board IBA by 4 years.

“Express” also tried to contact Sindh Chief Minister Rashid Chana’s spokesperson to know the position of the Sindh government in this regard. It should be noted that the first four-year term of office of the Executive Director of IBA ends on January 13, 2024.

On the other hand, in the light of this letter of the Advocate General of Sindh, in which it has been stated that the officers and employees of the IBA are not civil servants and the IBA has no relation with the elections and administrative affairs, while giving a legal opinion to the Government of Sindh. It should be noted that like the IBA Act, there are also Acts of other public universities and examination boards in Sindh, while the Sindh government seeks permission from the Election Commission for the appointment of deans and vice-chancellors of all public universities after the approval of the Chief Minister.

Appointments are made with the same permission. The same practice is also continued in the Education Examination Board, where before the appointment of the Chairman, Controller of Examination and Secretaries, an advertisement has been issued with the permission of the Election Commission, where now the question has arisen whether Now there is no need for this practice in the rest of the universities and education boards as well.
