Peshawar: The Chief Justice of Peshawar High Court has said that the election is the trust of the nation and a very important issue, we will not allow anyone to delay the election.
A two-member special bench headed by Chief Justice Muhammad Ibrahim Khan heard the petition filed in Peshawar High Court regarding conducting elections under the supervision of the judiciary. The other judge who participated in the bench was Justice Shakeel Ahmed.
During the hearing, Advocate General, Additional Attorney General, Election Commission counsel and petitioner’s counsel appeared in the court.
Advocate General Umar Javed said that the Election Commission’s notification was not challenged in this application because when this application was filed, the notification of AROs and DROs had not been issued.
Chief Justice Peshawar High Court Justice Muhammad Ibrahim Khan remarked that the Lahore High Court has suspended the notification of the Election Commission. On which the petitioner’s lawyer Muazzam Butt said that the Lahore High Court has suspended the Election Commission’s notification of ROs and DROs.
The Chief Justice remarked that currently more than 700 orders of three MPOs have been issued in the province, the administration has no other work to focus on issuing orders of three MPOs.
Justice Mohammad Ibrahim Khan said that under such circumstances, is a clean and transparent election possible under such an administration? Can these officers perform their duties in such a situation?
Advocate General said that the provincial government has data that there is only one party which is holding rallies without permission, and not giving affidavit.
On this, the Chief Justice said that when such (election) season comes, then the orders of three MPOs are issued.
The Chief Justice said that the Election Commission has the authority to take action against those who violate, how many officers have been taken action against and punished so far? On this, the lawyer of the Election Commission said that action has been taken against several violators.
The Chief Justice said that everyone wants the elections to be clean and transparent. You (applicant) do so amend this application, you have filed the application earlier not challenged the notification you challenge it then you will hear it.
The Chief Justice of Peshawar High Court said that the election is the trust of the nation and a very important national matter, it will not be delayed. The election date will not be extended or reduced by one day.
PTI lawyers sought respite for supplementary application. On which the court said that the case will be heard further after the supplementary application.
